These Terms of Service ("Terms") govern your access to and use of the CryptoGuard website (the "Site") and any services we provide (the "Services"). The Site and Services are operated by CryptoGuard ("CryptoGuard", "we", "us", or "our").
1. Acceptance of Terms
By accessing the Site or engaging us, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Engagement & Scope of Work
Information on the Site is informational and does not, by itself, create a client relationship. A client relationship begins only when both parties sign a written engagement letter or statement of work that sets out scope, deliverables, fees, timing and applicable terms. Until then, communications are exploratory and without obligation.
3. No Guarantees of Recovery or Outcome
Cryptocurrency recovery and investigation work is inherently uncertain. Outcomes depend on factors outside our control, including the cooperation of third-party services, jurisdictional limitations, and the actions of bad actors. We do not guarantee recovery of any specific asset or any specific outcome. Anyone offering you a guaranteed recovery should be treated with great caution.
4. No Legal, Tax or Investment Advice
Our Services are technical and forensic in nature. We do not provide legal, tax, accounting or investment advice. We do not recommend the purchase, sale or holding of any digital asset. You are responsible for engaging qualified professionals for advice in those areas.
5. Acceptable Use
You agree not to use the Site or Services to:
- Violate any applicable law, regulation or third-party right.
- Impersonate any person, misrepresent your affiliation, or interfere with our systems.
- Submit false, misleading or fraudulent information.
- Reverse engineer, scrape, or attempt to gain unauthorised access to our systems.
- Use the Services in connection with any unlawful activity, including the laundering of funds.
We may suspend or terminate access at any time for actual or suspected violations of these Terms.
6. Intellectual Property
The Site, including its content, design, logos and code, is owned by CryptoGuard or our licensors and protected by intellectual-property laws. You may use the Site for personal, non-commercial use only. You may not copy, distribute, modify or create derivative works without our prior written consent.
7. User Submissions
Information you submit through forms is treated under our Privacy Policy. You represent that any information you provide is accurate and that you have the right to share it. Do not include private keys, seed phrases or wallet passwords in any submission.
8. Third-Party Links
The Site may contain links to third-party websites or services. We do not control and are not responsible for those third parties. Your interactions with them are governed by their own terms.
9. Disclaimer of Warranties
The Site and any content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, CryptoGuard and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising out of or relating to your use of the Site or Services. Our aggregate liability arising out of or relating to these Terms or the Services will not exceed the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless CryptoGuard from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of your use of the Site or Services, your violation of these Terms, or your violation of any law or third-party right.
12. Governing Law & Venue
These Terms are governed by the laws of the jurisdiction in which CryptoGuard is established, without regard to conflict-of-laws principles. The competent courts of that jurisdiction will have exclusive jurisdiction over disputes arising under these Terms, except where mandatory law provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of the Site or Services after a change indicates acceptance of the updated Terms.
